1. Introduction
1.1 This Acceptable Use Policy ("AUP" or "Policy") sets out the terms on which you may access and use the website at https://store.elevatetech.biz and related environments (the "Website") operated by Elevate Tech Limited ("Elevate Tech", "we", "us" or "our").
1.2 This Policy forms part of, and must be read together with, our Terms and Conditions of Sale and Website Use, our Website Security and Fraud Prevention Policy, our Intellectual Property Policy and our Privacy Policy.
1.3 By accessing or using the Website, you agree to comply with this Policy. If you do not agree, you must not use the Website.
2. Who This Policy Applies To
2.1 This Policy applies to all users of the Website, including registered account holders, business customers, their employees and authorised representatives, and any visitor.
2.2 You are responsible for ensuring that all persons who access the Website through your account or your internet connection are aware of, and comply with, this Policy.
3. Permitted Use
3.1 You may use the Website only:
(a) for lawful purposes; (b) in accordance with these policies and all applicable laws and regulations; and (c) for legitimate business purposes connected with evaluating, purchasing, managing and supporting orders of Goods.
3.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its content for the purposes described in clause 3.1, as set out in the Intellectual Property Policy.
4. Prohibited Conduct
4.1 You must not:
(a) use the Website in any way that breaches any applicable law or regulation, or that is fraudulent, unlawful or has any unlawful or fraudulent purpose or effect; (b) use the Website to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); (c) impersonate or attempt to impersonate Elevate Tech, an Elevate Tech employee, another user, or any other person or entity; (d) provide false, inaccurate or misleading information, or create an account using a false identity or on behalf of a person without authority; (e) use the Website in any way that could disable, overburden, damage or impair it, or interfere with any other party's use of the Website; (f) use any robot, spider, scraper, crawler or other automated means or process to access, monitor, copy, harvest or extract data from the Website or its content without our prior written consent; (g) systematically extract, reproduce, republish, scrape or re-use any part of the Website, its content, product data, pricing or Technical Data, including for the purposes of building a database or competing service; (h) bypass, circumvent, disable or otherwise interfere with any security, authentication, rate-limiting, access-control or technological protection measure of the Website; (i) introduce, transmit or attempt to introduce any virus, worm, trojan, ransomware, logic bomb, keystroke logger, or other material that is malicious or technologically harmful; (j) attempt to gain unauthorised access to, interfere with, damage or disrupt the Website, the server on which it is stored, or any server, computer or database connected to it; (k) attack the Website via a denial-of-service or distributed denial-of-service attack; (l) probe, scan or test the vulnerability of the Website or any associated system or network, or breach any security or authentication measures, without our prior written authorisation; (m) decompile, reverse-engineer, disassemble or otherwise attempt to derive the source code of any software comprising or made available through the Website, except to the extent permitted by law; (n) frame, mirror or create derivative works based on the Website or its content without our prior written consent; (o) collect or harvest any information, including personal information, about other users; (p) post, transmit or make available any content that is unlawful, defamatory, obscene, harassing, threatening, discriminatory, infringing or otherwise objectionable; or (q) use the Website in any manner inconsistent with these policies, including the Website Security and Fraud Prevention Policy and the Intellectual Property Policy.
5. Account Responsibilities
5.1 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
5.2 You must:
(a) use strong, unique credentials and keep them secure; (b) not share your credentials or permit unauthorised access to your account; (c) ensure that the contact and business information associated with your account is accurate and current; and (d) notify us immediately at support@elevatetech.biz of any actual or suspected unauthorised use of, or security breach affecting, your account.
6. Content and Submissions
6.1 Where the Website allows you to submit content (for example, queries, reviews, requests for quotation, or account information), you must ensure that your content is accurate, lawful, not misleading, and does not infringe any third-party right.
6.2 You grant Elevate Tech a non-exclusive, royalty-free, irrevocable licence to use, store and process content you submit, to the extent necessary to operate the Website and provide our services, subject to the Privacy Policy.
6.3 We may, but are not obliged to, review, moderate, edit or remove any content that we consider, in our reasonable discretion, to breach this Policy or applicable law.
7. Third-Party Links and Services
7.1 The Website may contain links to third-party websites and services. We provide these links for convenience only and do not endorse, and are not responsible for, the content, products, services or practices of those third parties. Your use of third-party websites and services is at your own risk and subject to their terms.
8. Availability and Changes
8.1 We do not guarantee that the Website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw, discontinue or change all or any part of the Website without notice. We are not liable to you if the Website is unavailable at any time or for any period.
8.2 We may update the content of the Website at any time. Although we make reasonable efforts to keep content current, we are under no obligation to do so, and content may be out of date at any given time.
9. Monitoring and Enforcement
9.1 We may monitor use of the Website to ensure compliance with this Policy and to protect the security and integrity of the Website, in accordance with the Privacy Policy and the Website Security and Fraud Prevention Policy.
9.2 Where we determine, in our reasonable discretion, that you have breached this Policy, we may take any action we consider appropriate, including:
(a) issuing a warning; (b) temporarily or permanently suspending or restricting your access to the Website or your account; (c) cancelling pending Orders; (d) removing or disabling content; (e) taking legal action against you, including for recovery of all costs (including reasonable legal costs) on an indemnity basis; and (f) disclosing information to, and co-operating with, law enforcement authorities or regulators where required by law or where we consider it appropriate.
9.3 We exclude liability for any action we may take in response to a breach of this Policy, to the maximum extent permitted by law.
10. Reporting Misuse
10.1 If you become aware of any misuse of the Website, any security vulnerability, or any breach of this Policy, please report it to support@elevatetech.biz. Reports relating to security should follow any responsible-disclosure guidance set out in the Website Security and Fraud Prevention Policy.
11. Amendments
11.1 We may amend this Policy from time to time. The updated version will be published on the Website with a revised "Effective Date" and "Version". Your continued use of the Website after publication constitutes acceptance of the amended Policy.
12. Governing Law and Dispute Resolution
12.1 This Policy is governed by the laws of the Republic of South Africa.
12.2 Any dispute arising from this Policy is subject to the dispute resolution and jurisdiction provisions of our Terms and Conditions of Sale and Website Use (negotiation, then mediation, then arbitration in Cape Town under AFSA rules, with the non-exclusive jurisdiction of the Western Cape Division of the High Court).
