1. Introduction

1.1 This Electronic Communications and Consent Policy ("Policy") explains how Elevate Tech Limited ("Elevate Tech", "we", "us" or "our") communicates with you electronically, the basis on which we send direct marketing, and your consent and choices in relation to such communications.

1.2 This Policy is informed by the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Protection of Personal Information Act 4 of 2013 ("POPIA") and, where applicable, the Consumer Protection Act 68 of 2008 ("CPA").

1.3 This Policy forms part of, and must be read together with, our Terms and Conditions of Sale and Website Use, our Privacy Policy and our Cookie Policy.

2. Definitions

2.1 In this Policy:

"Data Message" means data generated, sent, received or stored by electronic means, as defined in ECTA;

"Direct Marketing" means the direct or indirect approach of a data subject (whether in person, by mail, or by electronic communication) for the purpose of promoting or offering to supply goods or services, or requesting a donation, as contemplated in POPIA;

"Electronic Communication" means any communication sent or received by electronic means, including email, SMS, in-app messages, push notifications and similar channels;

"Transactional Communication" means a communication relating to your account, an Order, a payment, delivery, returns, support, security, or another operational or legal matter, as distinct from Direct Marketing.

3. Consent to Electronic Communications

3.1 By registering an account, placing an Order, or otherwise providing us with your contact details, you consent to receiving Electronic Communications from us in connection with your relationship with us.

3.2 In accordance with ECTA, you agree that:

(a) Data Messages and electronic records satisfy any legal requirement that a communication or document be in writing; (b) information is not without legal force or effect merely because it is in the form of a Data Message; and (c) an Electronic Communication is regarded as having been sent and received in accordance with the provisions of ECTA.

3.3 You may at any time request that operational communications be provided by an alternative reasonable means where the law requires or permits, by contacting us at support@elevatetech.biz.

4. Transactional Communications

4.1 We will send you Transactional Communications as necessary to operate your account and fulfil our obligations, including communications relating to:

(a) account registration, verification and security; (b) Order confirmation, processing, dispatch and delivery; (c) payments, invoices and statements (including Credit Account matters); (d) returns, refunds, replacements and warranty matters; (e) changes to our policies or terms; and (f) other operational, legal or regulatory matters.

4.2 Transactional Communications are not Direct Marketing. Because they are necessary for the performance of our contract with you and the operation of your account, you cannot opt out of essential Transactional Communications while you maintain an account or have an active Order, although you may close your account in accordance with our terms.

5. Direct Marketing

5.1 We send Direct Marketing by electronic means (such as newsletters, product information and promotional offers) only where:

(a) you have consented to receiving such communications; or (b) you are an existing customer of ours, we obtained your contact details in the context of a sale of goods or services, the Direct Marketing relates to our own similar products or services, and you were given a reasonable opportunity to object to such use of your details at the time of collection and in each subsequent communication, and you have not objected.

5.2 In all cases, every Direct Marketing communication will:

(a) identify Elevate Tech as the sender and provide our contact details; (b) contain a clear and simple mechanism to opt out, unsubscribe or object; and (c) not disguise or conceal the identity of the sender or the purpose of the communication.

5.3 We will not send Direct Marketing to a person who has not previously been our customer, or who has not consented, except as permitted by law (which, under POPIA, requires the data subject's consent for unsolicited electronic Direct Marketing).

5.4 Where consent is required, we may ask for your consent only once, unless you have already given or refused it, in accordance with section 69 of POPIA.

6. Managing Your Communication Preferences

6.1 You may manage your communication preferences, including which categories of Direct Marketing you receive, by:

(a) using the unsubscribe or preference link in any marketing communication; (b) updating the communication preferences in your account; or (c) contacting us at support@elevatetech.biz or the Information Officer at wade@elevatetech.biz.

6.2 We will give effect to your opt-out or objection as soon as reasonably possible. After you opt out of Direct Marketing, you may still receive Transactional Communications, and there may be a short period before all marketing systems are updated.

6.3 Withdrawing consent to Direct Marketing does not affect the lawfulness of processing carried out before withdrawal, and does not affect our right to send you Transactional Communications.

7. SMS, Push Notifications and Other Channels

7.1 Where you provide a mobile number or enable push notifications, you may receive Transactional Communications and, where you have consented, Direct Marketing through those channels. You can manage SMS preferences by following the opt-out instructions provided, and push notifications through your device settings.

8. Cookies and Online Marketing

8.1 Online and behavioural marketing delivered through cookies and similar technologies is governed by our Cookie Policy. You can manage cookie-based marketing through the cookie preference mechanisms described in that policy.

9. Communications From You

9.1 You may contact us electronically at support@elevatetech.biz (general queries) or wade@elevatetech.biz (Information Officer and privacy matters). We treat communications you send in accordance with our Privacy Policy.

9.2 An Electronic Communication you send to us is regarded as received only when it actually comes to our attention or is capable of being retrieved and processed by us. Please retain proof of important communications.

10. Accuracy of Contact Details

10.1 You are responsible for ensuring that the contact details associated with your account are accurate and current, so that you receive Transactional Communications and any communications you have chosen to receive. We are not responsible for communications not received due to incorrect or out-of-date contact details that you provided.

11. Personal Information

11.1 Our processing of personal information in connection with Electronic Communications and Direct Marketing is governed by our Privacy Policy and the POPIA Data Subject Rights Policy. You have the right to object to Direct Marketing and to withdraw consent at any time.

12. Amendments

12.1 We may amend this Policy from time to time. The updated version will be published on the Website with a revised "Effective Date" and "Version". Your continued use of the Website and our services after publication constitutes acknowledgement of the amended Policy.

13. Governing Law and Dispute Resolution

13.1 This Policy is governed by the laws of the Republic of South Africa.

13.2 Complaints regarding Direct Marketing or the processing of your personal information may be addressed to the Information Officer and, where applicable, the Information Regulator. Any other dispute arising from this Policy is subject to the dispute resolution and jurisdiction provisions of our Terms and Conditions of Sale and Website Use.
